FreakWax Privacy Policy

FreakWax ("we," "us," or "our") operates the FreakWax platform, providing interactive music collectibles to collectors and distribution services to artists. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our website and services.


1. Information We Collect

 

  1. Account Information: When you create an account, we collect your email address and password. If you sign up using a social login provider, we receive your name and email from that service.
     

  2. Artist Information: If you upload content to FreakWax, we collect additional information including your display name, profile image, and PayPal email address for payment processing.
     

  3. Payment Information: We use third-party payment processors (Wix Payments and PayPal) to handle transactions. We do not store your credit card details on our servers. Payment processors provide us with transaction confirmations and limited billing information.
     

  4. Collection Data: We record information about your purchases, including which collectibles you own, edition numbers, and gift transfers you send or receive.
     

  5. Usage Information: We collect data about how you interact with our platform, including pages visited, features used, and interactions with the music player (such as play events and scratch interactions).
     

  6. Device and Technical Information: We automatically collect your IP address, browser type, operating system, and device identifiers when you access our services.

2. How We Use Your Information


We use your information to: provide and maintain our services; process transactions and send related information; enable artists to receive payouts for their sales; facilitate gift transfers between users; communicate with you about your account, purchases, and platform updates; analyze usage patterns to improve our services; detect and prevent fraud or unauthorized access; and comply with legal obligations.


3. Information Sharing

 

  1. With Artists: When you purchase a collectible, the artist may see that a purchase was made and basic analytics about their sales. Artists do not receive your personal contact information unless you choose to share it.
     

  2. Gift Recipients: When you gift a collectible, the recipient will see your display name or username as the sender.
     

  3. Service Providers: We share information with third-party vendors who help us operate our platform, including payment processors (Wix Payments, PayPal), hosting providers (Wix), and analytics services.
     

  4. Legal Requirements: We may disclose your information if required by law, court order, or governmental regulation, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
     

  5. Business Transfers: If FreakWax is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
     

  6. We do not sell your personal information to third parties for marketing purposes.


4. Data Retention


We retain your account information for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within 90 days, except where we need to retain certain information for legal or business purposes (such as transaction records for tax compliance). Collectibles you have purchased or received as gifts will remain in the system as they represent ownership records.


5. Your Rights and Choices

 

  1. Access and Correction: You can access and update your account information through your account settings.
     

  2. Account Deletion: You may request deletion of your account by contacting us at heyo@freakwax.com.
     

  3. Marketing Communications: You can opt out of promotional emails by clicking the unsubscribe link in any marketing message.
     

  4. Cookies: Most browsers allow you to refuse cookies or alert you when cookies are being sent. Note that some features of our service may not function properly without cookies.
     

  5. If you are located in the European Economic Area, you may have additional rights under GDPR, including the right to data portability and the right to lodge a complaint with a supervisory authority.


6. Security


We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

FreakWax is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.


8. International Data Transfers


FreakWax is operated from Canada. If you access our services from outside Canada, please be aware that your information may be transferred to, stored, and processed in Canada or other countries where our service providers operate. By using our services, you consent to such transfers.

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting the new policy on our website and updating the effective date. Your continued use of our services after changes become effective constitutes acceptance of the revised policy.
